El Tribunal Constitucional ha admitido a trámite el recurso que el PP interpuso contra la reforma del reglamento del Senado, aprobada por mayoría absoluta el pasado 21 de noviembre para adecuarlo a la ley orgánica del tribunal (LOTC).
En una providencia notificada hoy, el Alto Tribunal acuerda admitir a trámite el recurso, promovido por más de cincuenta senadores del Grupo Popular en el Senado, y dar traslado del mismo al Congreso, al Senado y al Gobierno para que, en el plazo de quince días, se personen en el proceso y formulen alegaciones.
La reforma del reglamento del Senado permite a las Asambleas legislativas de las Comunidades Autónomas proponer candidatos de entre los que la Cámara Alta debe designar a los cuatro que le corresponden de los doce que forman el pleno del Tribunal Constitucional.
Para el PP, que recurrió el reglamento el pasado 10 de enero, el texto no se ajusta a la Constitución, ya que ésta determina en su artículo 159.1 que la renovación de los doce magistrados del TC se hará a propuesta del Congreso, el Senado, el Gobierno y el Consejo General del Poder Judicial, sin mencionar a los Parlamentos autonómicos.
El PP también recurrió en su momento el artículo de la LOTC que establece la participación de las Asambleas legislativas en la elección de magistrados por entender que "desapoderaba" al Senado de una de sus competencias constitucionales, pero el Alto Tribunal lo rechazó el pasado día 9.
Según el Constitucional, ningún precepto de la Carta Magna impide expresamente que los Parlamentos autonómicos puedan intervenir en la elección de magistrados presentando candidaturas al Senado.
