La Fiscalía de la Audiencia Nacional ha pedido al juez Eloy Velasco que reclame la entrega a España de los seis presuntos piratas detenidos ayer tras atacar el buque 'Patiño' en aguas del Índico y que ordene su ingreso en prisión provisional.
Así lo ha solicitado la fiscal Teresa Sandoval en un escrito remitido al titular del Juzgado Central de Instrucción número 6 de este tribunal después de que esta mañana, tras haber recibido la notificación oficial de los hechos por parte del Ministerio de Defensa, le solicitara que le informara sobre la competencia de la Audiencia Nacional para investigar los mismos.
El Ministerio Público los considera culpables de un delito de piratería y otro de depósito de armas de guerra y señala que existe un 'vínculo de conexión relevante con España' al tratarse de un buque español atacado en aguas internacionales y que ningún estado tiene jurisdicción preferente.
Por todo ello, concluye que procede acordar el ingreso en prisión provisional incondicional de Mohamed Said Mohamed, de 25 años; Mohamed Aden Mohamed e Issah Abdullah Issa, de 26; Mohamed Abdullah Hassan, de 28 y Mohamed Said Mohamed y Abdillahi Mohamed Gouled, ambos de 33, así como su traslado y puesta a disposición de la Justicia española.
La petición de la Fiscalía se produce después de que Velasco, que previsiblemente legalizará la situación de los seis presuntos agresores este viernes, haya reclamado un informe complementario a Defensa para que le aclare la situación de los convenios internacionales en vigor, para estudiar las distintas opciones jurídicas antes de decidir si ordena el traslado a España de los arrestados.
