La Fiscalía ha solicitado a la Audiencia Nacional que ordene la busca y captura de un internauta que pidió en Facebook que la banda terrorista ETA hiciera estallar cien kilos de explosivos en el Palacio de la Zarzuela e insultó de forma repetida a los miembros de la familia real, después que no se haya presentado al juicio, según informaron fuentes jurídicas.
La Sección Segunda de la Sala de lo Penal ha suspendido el juicio después de que el acusado, David José Duaigues Martí, no se presentara a la vista en la que se enfrentaba a un año de prisión y siete de inhabilitación absoluta por un delito de enaltecimiento del terrorismo.
El representante del Ministerio Público ha solicitado en una vista a puerta cerrada la orden de detención del procesado, mientras que su abogado ha pedido que se le cite primero para otro día, unas peticiones sobre las que deberá decidir el tribunal. En su escrito provisional de acusación, el fiscal Fernando Burgos solicita que el acusado, de origen catalán, sea condenado a un año de cárcel por un delito de enaltecimiento del terrorismo, al entender que sus mensajes constituían 'una loa a la organización terrorista ETA y al empleo de la violencia terrorista'.
En los dos comentarios que se reflejan en el escrito de acusación, fechados los días 3 y 4 de enero de 2012, el acusado insultaba a los miembros de la familia real y les llamaba 'delincuentes' y 'energúmenos', entre otros epítetos, a lo que añadía: 'Ojalá los de ETA os pusieran más bombas, pandilla de gilipollas, viva ETA y el terrorismo'. A estas palabras adjuntó un fotomontaje en el que aparecían imágenes del Monarca y su familia y del Palacio de la Zarzuela con otras en las que se podían observar explosiones.
