Varias asociaciones para la recuperación de la Memoria Histórica han denunciado en el Consejo General del Poder Judicial (CGPJ) al presidente de la Sala de lo Penal del Tribunal Supremo, Juan Saavedra, por dictar resoluciones en la causa contra Baltasar Garzón después de haber sido recusado por éstas.
Las asociaciones formulan denuncia contra Saavedra por una falta disciplinaria muy grave relativa a la "reiterada y continuada inobservancia del deber de abstención a sabiendas de que concurre alguna de las causas legalmente previstas".
Éstas pidieron el pasado mes de junio al Supremo la recusación de los magistrados que admitieron la querella por prevaricación del sindicato ultraderechista Manos Limpias contra el juez Garzón por declararse competente para investigar las desapariciones durante la Guerra civil y el franquismo -Juan Saavedra, Adolfo Prego, Joaquín Giménez, Francisco Monterde y Juan Ramón Berdugo Gómez-.
Según alegan en la denuncia, firmada por el abogado Fernando Magán, "la continuada participación del recusado en la presidencia de la Sala ha vulnerado el derecho de mis representados a un procedimiento sin dilaciones indebidas, retrasando en más de ocho meses la tramitación del incidente de recusación conforme a Derecho".
Además sostienen que Saavedra "mantiene paralizada" la cuestión de competencia de los Juzgados de Instrucción de Granada y El Escorial, que entienden que la investigación de los crímenes del franquismo es competencia de la Audiencia Nacional, y ha denegado a las asociaciones de víctimas su derecho a ser parte en el procedimiento contra el juez cuando ha admitido a Falange.
