La Audiencia Provincial de Madrid ha desestimado la querella interpuesta por Sogecable contra Jaume Roures y Taxto Benet, de Mediapro; contra el presidente y vicepresidente de la Liga, José Luis Astiazarán y Javier Tebas; así como contra el director general de TV3, Joan Majó, y el ex director general de Audiovisual Sport Daniel Margalef.
Según señala Mediapro en un comunicado, la sentencia señala que "no se ha encontrado indicio delictivo alguno tras haber diseccionado minuciosamente los hechos", por lo que dicta "auto de sobreseimiento libre, pues ante la completa certidumbre acerca de la inexistencia de delito, lo obligado es liberar definitivamente al sujeto de toda dependencia".
Mediapro recuerda en su nota que en la querella interpuesta por Sogecable/AVS, y que fue sobreseída en primera instancia, se acusaba a los querellados de simulación de contrato.
Los hechos se remontan al 18 de septiembre de 2007 cuando AVS, a través de Daniel Margalef y Mediapro, con la intermediación de la Liga, llegaron a un acuerdo para permitir a Mediapro recibir la señal de los partidos de fútbol que Sogecable les denegaba.
Sogecable acusó entonces a Daniel Margalef de carecer de poderes para llegar a tal acuerdo por haber sido cesado diez días antes, aunque la Audiencia Provincial de Madrid confirma en su sentencia que Margalef, en la fecha de los acuerdos, era el legítimo director general y representante legal de AVS.
