El pleno del Congreso rechazó el martes la tramitación de una iniciativa del Partido Popular para recuperar la figura del recurso previo de inconstitucionalidad para los Estatutos, según la cual el Tribunal Constitucional podría revisar estas normas antes de su entrada en vigor.
Se trata de un mecanismo de control que existió hasta el año 1985 según el cual un Estatuto no puede desarrollarse hasta que el Constitucional confirme su plena adecuación a la Carta Magna.
Según el PP, la recuperación de esta figura evitaría que se repitieran casos como el del Estatut catalán, que está en vigor a pesar de esperar desde hace casi cuatro años la sentencia del Constitucional.
"Muchos de los problemas que actualmente aquejan a nuestra sociedad en la conformación de algunas de nuestras autonomías tendría una solución más fácil si hubiésemos mantenido el recurso de control previo de constitucionalidad en lo referido a los Estatutos", afirmó el diputado Arturo García Tizón.
Los populares consiguieron el único apoyo de UPyD. El resto rechazó la propuesta alegando que supondría la entrada del TC en el proceso legislativo. Según el socialista Jesús Quijano, su recuperación supondría "convertir el TC en una tercera cámara". Asimismo, recordó que el modelo de control constitucional debe ser posterior a la entrada en vigor de las leyes.
Desde Esquerra Republicana, esta iniciativa se interpretó como un intento del PP de "redimirse" o "expiar sus culpas" por el "penoso" trance del Estatut.
