La Justicia saudí ha ordenado a los tribunales que acepten los documentos de identidad de las mujeres, después de que algunos magistrados ultraconservadores obligaran a saudíes a ser identificadas por un muarref (familiar). El Consejo Supremo de Justicia afirmó que ningún organismo puede rechazar estos carnés bajo ningún pretexto, porque eso significa una aversión a los documentos emitidos oficialmente por el Estado, informó el diario saudí Al Hayat.
Esta decisión tiene el objetivo de acabar con el conflicto que se producía en ocasiones en los tribunales al negarse los jueces a aceptar la validez de los documentos y al rechazar las mujeres la compañía del muarref. De acuerdo a la legislación saudí, recordó el Consejo, si las mujeres poseen un documento de identidad no necesitan que un pariente las identifique ante la corte.
Las autoridades saudíes comenzaron a emitir en 2002 documentos de identidad para las mujeres que lo desearan, sin imponerlo en un principio como una obligación para evitar el rechazo de la corriente ultraconservadora del reino. Sin embargo, diez años más tarde, en 2012, el Consejo de Ministros decidió que todas las mujeres tenían que disponer de un documento de identidad y dio un plazo de siete años para ello. Varios jueces expresaron su rechazo a esta resolución al considerar que iba en contra de la sharía o ley islámica, porque el documento va acompañado de una fotografía de la mujer.
Arabia Saudí es un reino ultraconservador en el que rige una estricta aplicación de la sharía y donde la mujer tiene prohibido conducir y viajar fuera del país sin un tutor, entre otras restricciones.
