El Senado estadounidense ratificó ayer por 79 votos a favor y 19 en contra la decisión tomada hace una semana por la Cámara de Representantes: el Gobierno podrá transferir presos de Guantánamo a EEUU para ser juzgados.
En teoría, esta medida facilita la labor del presidente Barack Obama de cerrar la prisión; en la práctica no es tan sencillo.
Ninguna cárcel de máxima seguridad quiere acoger a los detenidos y los 45 días de plazo requeridos antes de cualquier traslado dan amplio margen a los legisladores que se oponen para sembrar más obstáculos.
Expira el plazo
Además, la medida sólo concierne al centenar de presos que podrían enfrentarse a un juicio; sea por la vía civil o en las comisiones militares, los tribunales especiales creados en 2006 por el Gobierno de Bush y que Obama ha mantenido.
Pero el problema es que el plazo fijado por el propio Obama de cerrar Guantánamo, el 22 de enero de 2010, sigue en pie.
El Tribunal Supremo admitió a trámite el martes una petición de 17 prisioneros chinos de la minoría uigur (encarcelados desde hace siete años) que quieren ser liberados en EEUU y no en la República de Palaos, como propuso el Gobierno en junio.
A fecha de hoy, 223 prisioneros siguen en Guantánamo. Washington los ha dividido en tres categorías: unos 80 ya pueden ser liberados y transferidos a otros países; entre 40 y 60 serán juzgados; el resto, algo menos de cien, permanecerán encerrados indefinidamente al ser considerados muy peligrosos.
