Un Tribunal de Apelaciones aceptó ayer la competencia de los tribunales uruguayos para juzgar el caso presentado por Roberto Da Silva y Alberto Triunfo contra la cantante española Rosana por el supuesto plagio de la canción "Uruguay te queremos ver campeón".
Esta decisión del tribunal de segunda instancia implica que la intérprete de "Talismán" o "A fuego lento" y su compañía discográfica, Warner Music Spain, deberán afrontar un juicio en el país sudamericano.
La demanda fue presentada por dos músicos uruguayos en julio de 2007, que consideraron que la canción "Soñaré" de Rosana, contenía importantes similitudes con "Uruguay te queremos ver campeón", compuesta por ellos, informa el portal Montevideo.com.
Así, los compositores presentaron ante la justicia uruguaya una demanda por daños y perjuicios.
Entonces se entendió que los tribunales competentes para juzgar este asunto eran los uruguayos, lo que fue rechazado por la defensa de Rosana, al aducir que los convenios internacionales no aclaraban qué tribunales deberían intervenir en casos como éste.
De este modo, los tribunales sentenciaron que no eran competentes en agosto de 2008.
Sin embargo, los denunciantes apelaron el fallo, que hoy fue revocado en su totalidad disponiendo la competencia de los tribunales uruguayos para entender en este caso.
Así, el caso regresará de nuevo a un tribunal de primera instancia para que se decida allí sobre el supuesto plagio de esta canción.
