El Tribunal Superior de Justicia de Madrid (TSJM) ha desestimado hoy el recurso de apelación que el diputado del PP en la Asamblea de Madrid Benjamín Martín Vasco interpuso contra la decisión del juez instructor del "caso Gürtel", Antonio Pedreira, de imponerle una fianza de 955.000 euros.
En un auto notificado hoy, la Sala Civil y Penal de este tribunal entiende que, en el caso de Martín Vasco, la fianza no debe bajar de todo el importe probable de las responsabilidades pecuniarias que pudieran declararse procedentes, más una tercera parte del mismo. según informa el TSJM en una nota de prensa.
La cantidad de 955.000 euros, considera la Sala, "no parece desproporcionada" cuando se atribuye a Martín Vasco la percepción ilegal de un total de 437.000 euros, según consta en los hechos descritos en el auto en el que el juez de la Audiencia Nacional Baltasar Garzón se inhibió del caso en favor del TSJM.
El tribunal recuerda además que Martín Vasco conoce estas imputaciones, porque ese auto no está declarado secreto, lo que invalida la pretensión de indefensión que el diputado autonómico del PP alegaba en su recurso de apelación a la fianza.
Según Garzón, Martín Vasco se dedicaba a la intermediación para conseguir adjudicaciones de proyectos urbanísticos en el Ayuntamiento de Arganda del Rey (Madrid) para Martinsa, una de las sociedades vinculadas a la supuesta trama de corrupción de Francisco Correa.
Pedreira, ante el que Martín Vasco compareció el pasado 5 de mayo, imputa a éste los delitos de cohecho, tráfico de influencias, fraude fiscal, asociación ilícita, blanqueo de capitales y falsedad.
