El Consejo General de la Abogacía Española (CGAE) ha asegurado hoy que el Gobierno no puede restringir la atención sanitaria mediante un real decreto ley, ya que limitar el derecho a la salud "colisiona" con la Constitución y con varios Estatutos de Autonomías.
En un comunicado, el CGAE rechaza el nuevo real decreto de medidas urgentes para garantizar la sostenibilidad del Sistema Nacional de Salud aprobado por el Ejecutivo, a quien recuerda que la atención sanitaria es un derecho "universal e igualitario" reconocido no solo en tratados internacionales, sino también en la Carta Magna y en diferentes estatutos autonómicos.
El CGAE ha advertido de que si bien la Constitución reconoce que el Gobierno puede aprobar normas con rango de ley por razones de extraordinario y urgente necesidad, no puede acogerse a esta potestad cuando afecten a derechos fundamentales o al régimen de las comunidades autónomas.
"Un mínimo de respeto a la labor legislativa parlamentaria exigiría que la reforma de la Ley General de Salud Pública o de los estatutos autonómicos se efectuase mediante otra norma con, al menos, idéntica tramitación parlamentaria", ha subrayado el Consejo de la Abogacía, que critica que se legisle "con tanta ligereza un derecho humano".
El CGAE también recuerda que en el derecho a la salud "no cabe la discriminación" por razón de nacimiento, origen racial, étnico, sexo, religión, convicción, opinión, edad, discapacidad, orientación o identidad sexual, enfermedad o cualquier otra circunstancia personal o social.
Por todo ello, el Consejo de la Abogacía ha defendido que la limitación del derecho a la atención sanitaria para los inmigrantes irregulares exige "el examen constitucional" de esta situación como parámetro de discriminación y exclusión.
