El acuerdo sobre fiscalidad y protección de los intereses financieros entre España y Reino Unido sobre Gibraltar que pretende acabar con la consideración de "paraíso fiscal" de la región entra este sábado en vigor tras su publicación en el Boletín Oficial del Estado (BOE).
El tratado persigue la eliminación del fraude fiscal y los efectos perjudiciales derivados de las características de un régimen fiscal que actualmente permite, por ejemplo, pagar un impuesto de sociedades sólo por los beneficios obtenidos en Gibraltar o ser considerado residente en la Roca aunque la residencia principal esté en España.
Se trata del primer tratado internacional que firman España y Reino Unido sobre Gibraltar desde el tratado de Utrech de 1715, por el que España cedió el uso del Peñón a los ingleses.

Firmado el pasado 4 de marzo de 2019 por el entonces ministro de Asuntos Exteriores, Josep Borrell, y por el ministro de la Presidencia británico, David Lidington, el tratado ha sido ratificado por los Parlamentos de ambos países, lo que ha retrasado su entrada en vigor.
El acuerdo resuelve la "soberanía fiscal" de la zona en beneficio de España y "permite acabar con una situación anacrónica y tremendamente perjudicial para España" sin debilitar su posición sobre la soberanía del Peñón, aseguró la ministra de Asuntos Exteriores, Arancha González Laya, en el Congreso.
Nuevas reglas fiscales
Así, establece reglas claras para resolver más fácilmente los conflictos de residencia fiscal de las personas físicas y para evitar la utilización de sociedades sujetas al régimen fiscal de Gibraltar por residentes fiscales en España o para la realización de actividades económicas en España.
Además, establece que las personas jurídicas tendrán residencia fiscal en España cuando establezcan una relación significativa con España, lo que se determina por la localización de la mayoría de sus activos, por la obtención de la mayor parte de sus ingresos o bien por que la mayoría de propietarios o directivos sean residentes fiscales en España.
Es, por tanto, una "herramienta eficaz" en la lucha contra la evasión fiscal y establece un incremento de la cooperación administrativa y un régimen de cooperación reforzada mediante un órgano de enlace y un comité conjunto de coordinación.
Fuentes de Exteriores han asegurado que, tal y como se señala en el propio texto del Acuerdo, el mismo no supone cambio alguno con respecto a la posición española o británica en cuanto a la soberanía y jurisdicción en relación con Gibraltar.
