La Fiscalía de Valencia se ha opuesto a que el juez acceda provisionalmente al cierre de la web calatravatelaclava.com , impulsada por Esquerra Unida del País Valencià (EUPV), porque considera que iría en contra del artículo 728.1 de la Ley de Enjuicamiento Civil (LEC), mientras que la defensa del arquitecto valenciano —él no ha estado presente en la vista— ha insistido en que a través de esta web se le hace "mofa" y se le da un trato "injurioso y vejatorio".
Por su parte, EUPV ha defendido, al igual que la fiscal, que se mantenga el uso de la página web hasta que se resuelva el fondo de la demanda interpuesta por el arquitecto contra la formación política por supuestamente atentar contra su derecho al honor.
EUPV, la demandada, ha alegado que la web sólo recoge la información de diferentes medios de comunicación, un contenido que ha dicho que tiene "relevancia pública por tratarse de contratos entre el arquitecto y la Generalitat y del dinero público de los valencianos", ha expuesto.
Así se han pronunciado las diferentes partes en la vista celebrada este jueves en el juzgado de primera instancia número 12 de Valencia para dirimir sobre la adopción de medidas cautelares en relación con la página web, tras la denuncia del arquitecto valenciano, que reclama 600.000 euros a EUPV como indemnización por su derecho al honor. El juez resolverá sobre esta petición en los próximos días.
