El Tribunal Supremo ha confirmado la indemnización de más de 14.000 euros que una inquilina deberá pagar a una mujer que se encontraba embarazada de trece semanas tras golpearle el vientre y ocasionarle la pérdida del feto. El alto tribunal considera "benévolo" que se absolviera a la agresora de un delito de aborto, pero recuerda que no puede modificar esta decisión al no haber recurrido la víctima.
La Sala de lo Penal ha desestimado el recurso que presentó la agresora, Mabel O., contra la sentencia de la Audiencia Provincial de Madrid que le consideraba culpable de una falta de lesiones y le imponía el pago de una multa y de 14.259 euros de indemnización a la víctima y su pareja.
El Supremo considera acreditado que Mabel tenía una habitación alquilada en el piso de la víctima con quien mantenía "malas relaciones por problemas de convivencia y supuestos atrasos en el pago del alquiler".
El 15 de septiembre de 2011, ambas mujeres discutieron y la condenada, consciente del embarazo de la víctima, le arrancó mechones de cabello y le propinó golpes en la zona abdominal, que produjeron el aborto del feto.
El Supremo respalda "razonada" sentencia de la Audiencia Provincial e incluso afirma que concluyó con una condena "favorable" para la recurrente. Recuerda que la "benévola valoración" del tribunal es "inmodificable" en vía casacional con el único recurso de la acusada.
