El Tribunal Supremo (TS) ha absuelto a un hombre al que la Audiencia Provincial de Barcelona impuso una pena de nueve años de prisión por abusar de su nieto desde que contaba con once años y hasta que tuvo catorce, al declarar prescritos los delitos de abusos sexuales por los que fue condenado.
Así lo ha acordado la Sala de lo Penal del Supremo en una sentencia, en la que estima el recurso de José G. contra la dictada el pasado mes de febrero por la Audiencia de Barcelona.
La Audiencia Provincial le condenó por haber abusado de su nieto desde 1993 en su vivienda y en el domicilio del menor, en una ocasión cuando fue a cuidarlo porque estaba enfermo.
El Tribunal consideró probado que el acusado era autor de un delito continuado de abusos sexuales y le prohibió acercarse a su nieto, quien le denunció a finales de 2006.
La madre de la víctima, que ejerce la acusación en su nombre, fijó el final del comportamiento del acusado en finales de 1997, lo que para el Supremo "está carente de todo apoyo probatorio".
"En la medida que hemos considerado que no cabe estimar que los hechos se reiteraron en ninguna ocasión posterior a finales de 1996, y la denuncia no fue presentada hasta avanzado el mes de diciembre de 2006, es claro que no puede afirmarse que no hubieran transcurrido los diez años de prescripción".
