El Tribunal Supremo ha aceptado la querella interpuesta por Falange Española de las JONS contra el juez de la Audiencia Nacional Baltasar Garzón por investigar los crímenes del franquismo, según un auto difundido el miércoles.
Esta querella, que se ha aceptado en contra de la opinión de la Fiscalía, se sumará a las del sindicato derechista Manos Limpias y la organización Libertad e Identidad por la misma causa, y podría derivar en juicio si la sala ve indicios suficientes para procesar al juez por prevaricación.
"Resulta palmario que la actual querella formalizada por Falange Española de las Jons es en todo punto coincidente con las previamente presentadas y admitidas a trámite (..), cuyos hechos coinciden sustancialmente y, dado ello, debe ser admitida sin retrotraer el estado actual de la causa", según el auto.
Los querellantes acusan al titular del juzgado número 5 de la Audiencia de montar un proceso a sabiendas de que no era competente para instruirlo y de conocer la prescripción de los delitos y el fallecimiento de víctimas y autores.
El magistrado, que defendió su competencia ante el Supremo el pasado septiembre, acusó al general Francisco Franco y a otros miembros de su Gobierno de la desaparición de miles de personas durante la guerra y la posguerra, en un proceso en el que autorizó la exhumación de fosas comunes, aunque luego se inhibió ante los tribunales provinciales para que fueran ellos los que decidieran.
Si hay juicio y Garzón es condenado, podría ser expulsado de la carrera judicial, según fuentes judiciales.
