El Tribunal Constitucional ha admitido a trámite el recurso que el Gobierno, a través de la Abogacía del Estado, interpuso el pasado 30 de marzo contra la Ley de Cajas aprobada por la Asamblea de la Comunidad de Madrid.
En una providencia notificada hoy, el Constitucional anuncia que tramitará la impugnación de los servicios jurídicos del Estado contra los artículos 12 y 28 de la Ley de Medidas Fiscales y Administrativas de la Comunidad de Madrid, el segundo de ellos referido a la ley de cajas que debe regir el proceso electoral en Caja Madrid.
Según el artículo 161.2 de la Constitución Española, la impugnación de una norma autonómica por parte del Gobierno supone la suspensión automática de ésta -sólo en lo que se refiere a los artículos recurridos-, que el Constitucional deberá ratificar o levantar en un plazo no superior a cinco meses.
