El magistrado del juzgado de instrucción número 4 de Palencia, Miguel Ángel Martín, se ha tomado en serio la inhibición de Garzón. Desde el pasado 15 de abril, cuando recibió la competencia, ha abierto diligencias para esclarecer un asesinato cometido en 1936. El juez ha tomado declaración a las familias de las víctimas halladas en varias fosas para saber quién cometió el crimen y por qué lo hizo.
Los restos de las víctimas ya fueron exhumados por la Asociación para la Recuperación de la Memoria Histórica de Palencia. El historiador y presidente del colectivo, Pablo García Colmenares, elaboró las biografías de los fusilados y ocultados bajo tierra en las fosas de Santoyo, Torquemada y Villamediana. A pesar de que García Colmenares cree que no hay ningún responsable directo vivo, el juez le ha solicitado la documentación. "Aunque no estén los culpables del delito, habrá que saber cómo se cometió", explica.
La asociación espera que las diligencias abiertas por el juez permitan hacer pruebas de ADN a cada cuerpo encontrado. Hasta ahora, habían recuperado los cuerpos y los habían identificado con técnicas forenses cuya fiabilidad es alta. Aún así, en algunos casos, como el de la fosa de Santoyo, con 25 cuerpos encontrados, todavía existen dudas de la identidad de los muertos.
