La comisaria de Derechos Humanos del Consejo de Europa, Dunja Mijatovic, ha atacado duramente al gobierno de Polonia por legitimar y azuzar la violencia homófoba en el país. Por medio de un memorándum publicado el jueves, la comisaria esboza ejemplos de estigmatización muy graves, como la delimitación de "zonas libres de LGTB" que han decretado algunas autoridades locales, además de casos de retórica incendiaria utilizada por políticos y figuras de la iglesia católica polaca, "incluidas personas que ocupan los más altos cargos del Gobierno". La Comisaria añade en el informe que "la estigmatización y el odio dirigidos a determinadas personas o grupos de personas conllevan un riesgo real de legitimación de la violencia, a veces con consecuencias fatales".
El partido nacionalista que gobierna Polonia, Ley y Justicia (por sus siglas polacas Pis), hizo de la lucha contra lo que llamó "ideología LGTB" la piedra de toque de sus campañas electorales de 2019 y 2020. El gobierno polaco ha rechazado las acusaciones vertidas por la Comisaria, alegando que los argumentos de la comisaria sobre las "zonas libres de LGBT" eran "engañosos", y que la institución del matrimonio como unión entre un hombre y una mujer era la que estaba consagrada en la constitución polaca.
Según la Comisaria, "la retórica estigmatizadora ha ido a menudo acompañada de acoso e intimidación a los activistas LGBTI por parte de los organismos encargados de hacer cumplir la ley y los servicios de la fiscalía" y cita el ejemplo de un activista detenido por colgar carteles de la Virgen María con un halo de arco iris. El gobierno polaco considera falaz el memorándum ya "que las actividades de la policía nunca pudieron ser consideradas como acoso o intimidación y que sólo fueron resultado del respeto a la ley vigente", indicó el Gobierno de Polonia.
Polonia y Hungría están bajo investigación formal de la UE por socavar la independencia de los tribunales, los medios de comunicación y las organizaciones no gubernamentales.
