La Justicia belga ha archivado este jueves, tras la petición de las autoridades españolas, la solicitud de extradición del cesado presidente de la Generalitat Carles Puigdemont y de los otros cuatro consellers también cesados tras la aplicación del artículo 155 que le acompañan en Bélgica desde finales de octubre.
La decisión judicial llega después de que el Tribunal Supremo español decidiera retirar las órdenes europeas de detención y entrega (OEDE) que pesaban sobre los cinco políticos catalanes. A falta de que el juez de la Cámara del Consejo (Tribunal de primera instancia) haga pública su decisión formal, fuentes de la defensa han indicado que en la sesión el magistrado ha confirmado que no había caso y se daba por cerrado.
Con esta decisión se formaliza también la supresión de las medidas cautelares que les fueron impuestas por el juez de instrucción cuando se presentaron ante las autoridades belgas el pasado 5 de noviembre, lo que les deja libertad para viajar fuera de Bélgica.
La audiencia se ha celebrado pasadas las 11:30 horas con la presencia de los abogados, pero no de los requeridos, y ha durado apenas unos minutos, ya que se trataba únicamente de un trámite para formalizar el cierre del caso.
Ya el pasado 5 de diciembre, cuando el Tribunal Supremo informó a las autoridades judiciales belgas de su decisión vía Eurojust, la Fiscalía de Bruselas informó de que las medidas cautelares impuestas a Puigdemont y sus exconsellers serían retiradas de manera "inmediata".
Puigdemont, junto a Clara Ponsatí, Antoni Comín, Lluís Puig y Meritxell Serret, están investigados por la Justicia española por presuntos delitos de sedición, rebelión, malversación de fondos públicos, desobediencia y prevaricación. Tras presentarse a las autoridades belgas el 5 de noviembre, Puigdemont, Toni Comín, Lluís Puig, Meritxell Serret y Clara Ponsatí, quedaron en libertad sujeta a medidas cautelares.
El juez dictó entonces para ellos la prohibición de salir del territorio belga sin acuerdo del juez de instrucción, residir en una dirección fija y presentarse personalmente cuando sean convocados por las autoridades judiciales o policiales, entre otras condiciones.
