El tripartito puede respirar tranquilo. El Consejo Consultivo de la Generalitat, a petición del Partido Popular (PP), ha estudiado el borrador de la Ley de Educación Catalana (LEC). Por lo que se refiere al bloque lingüístico, no ha encontrado inconstitucionalidad por ninguna parte. De esta manera, el Consejo, que es un organismo asesor, considera que el modelo de inmersión lingüística es correcto y acepta que Catalunya no aplique la tercera hora de español, como pide el Ministerio deEducación.
Redactado erróneo
Sin embargo, y dejando las cuestiones lingüísticas a parte, el Govern deberá cambiar cinco artículos que el Consejo considera que no cumplen con la legalidad. Dos hacen referencia a la Formación Profesional (FP). Según el Consejo, el redactado de la LEC no diferencia entre Formación Profesional reglada, que implica un título con validez en todo el Estado, y la no reglada, que sólo aporta un título válido en Catalunya. Algo similar ocurre con la enseñanza deportiva reglada y la no reglada. Según consta en el dictamen del Consejo, el redactado de la futura ley "no respeta las bases estatales" fijadas por la Ley Orgánica de Educación y por eso debe ser modificado.
Los otros dos artículos que deben ser enmendados versan sobre cuestiones detipo técnico y de poca trascendencia.
El dictamen no ha sido una sorpresa para nadie, especialmente por lo que se refiere al bloque lingüístico. Hay que tener en cuenta que los legisladores se basaron en las sentencias del Tribunal Constitucional que avalan la inmersión lingüística y que el catalán sea lengua vehicular del sistema educativo.
